Terms of Service

These Terms of Service ("Terms") govern your access to and use of the DeskEstate property management platform and the website at deskestate.com (together, the "Service"), operated by Solution Derivators, the company that owns the DeskEstate product ("DeskEstate", "we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

DeskEstate is subscription-based software that helps landlords, property managers, and real estate agencies manage properties, units, residents, leases, rent collection, and financial records. We may add, change, or remove features over time to improve the Service.

2. Accounts

You must provide accurate information when you register and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly of any unauthorised use. You must be at least 18 years old to use the Service.

3. Free trial

We may offer a free trial of the Service. At the end of the trial period, continued access requires a paid subscription. We may modify or discontinue trial offers at any time.

4. Subscriptions, billing, and payment

• Paid plans are billed in advance on a recurring basis according to the plan you select.
• Fees are stated in Pakistani Rupees (PKR) unless otherwise indicated and are exclusive of any applicable taxes.
• Subscriptions renew automatically at the end of each billing cycle unless cancelled before the renewal date.
• Except where required by law, payments are non-refundable, including for partial billing periods and unused features.
• We may change our pricing; we will give reasonable notice before changes affect your subscription.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law;
• Upload content that infringes the rights of others or that is false, harmful, or misleading;
• Attempt to gain unauthorised access to the Service, other accounts, or our systems;
• Interfere with, disrupt, or place undue load on the Service;
• Reverse engineer, copy, resell, or sublicense the Service except as permitted by law.

6. Your data and content

You retain ownership of the data and content you enter into the Service ("Your Data"). You grant us a limited licence to host, process, and display Your Data solely to provide and support the Service. You are responsible for the accuracy and legality of Your Data and for having the rights necessary to upload it. We handle Your Data in accordance with our Privacy Policy.

7. Intellectual property

The Service, including its software, design, branding, and content (excluding Your Data), is owned by DeskEstate and protected by intellectual property laws. These Terms do not grant you any right to our trademarks or other brand features.

8. Service availability

We work to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control.

9. Cancellation and termination

You may cancel your subscription at any time; access continues until the end of the current billing cycle. We may suspend or terminate your access if you breach these Terms or use the Service in a way that may cause harm to us or other users. After termination, you may request an export of Your Data within a reasonable period, after which it may be permanently deleted.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the maximum extent permitted by law. DeskEstate is a record-keeping and management tool; it is not a substitute for professional legal, tax, or accounting advice.

11. Limitation of liability

To the maximum extent permitted by law, DeskEstate will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of profits, revenue, or data. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the claim arose.

12. Indemnification

You agree to indemnify and hold DeskEstate harmless from any claims, damages, or expenses arising from your use of the Service, Your Data, or your breach of these Terms.

13. Governing law

These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to its conflict of law rules. The courts of Pakistan will have exclusive jurisdiction over any dispute arising from these Terms or the Service.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
